Privacy Policy

This Privacy Policy describes how Physical Rehabilitation Network, LLC (“us,” “we,” or “PRN”), 360 Physical Therapy's parent organization, collects, uses, and discloses your personal information on the websites where this Privacy Policy appears or is referenced (the “Sites”). This Privacy Policy is only applicable to the Sites. If any information collected on the Sites constitutes Protected Health Information as defined under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), then our Notice of Privacy Practices will apply to that information.

SECTION 1: What personal information we collect

PRN (and the vendors and other parties we use to perform services on our behalf) collects, receives, and develops several categories of personal information about you depending on the nature of your interactions with us:

We collect Contact Information and Other Identifiers. For example, we might collect your name, email address, phone number, and mailing address.
We collect Commercial, Customer Records, and Preference Information. For example, we may collect information about which types of services you’re interested in, your purchase history, your participation in promotional events or other programs, and your preferences. We also collect your comments, reviews, questions, and suggestions that you post or submit to us.

We collect Device, Internet and Network Activity Information. When you use or access the Sites, we may collect information about the browser, device and operating system you are using, device identifiers, MAC address, and your IP address. We might collect information about the site you came from, or the site you visit when you leave us. We may record and otherwise collect site interaction information and other electronic communications and content from your use of the Sites (such as the date, time, and location of your visit, content entry, mouse movements, screen captures, what areas of Sites you visit and for how long, what search terms or other data you enter, and what services, content, and links you view and click on). We may also embed technologies (which may include, for example, web beacons, tags, and pixels) in the emails and other communications we or our vendors send to you to help us understand how you interact with those messages, such as whether and when you opened a message or clicked on any content within the message. We may engage or otherwise permit other parties to also collect information in these ways.

We collect Location Information. We collect information about your location when you visit the Sites, using your IP address. We may also collect your zip code and mailing address, such as when you search for providers near you.
We collect Demographic Information. For example, we may collect your date of birth.

We collect Payment Information. We, or our vendors, may collect your credit or debit card information, account information, or other payment details if you make a payment for services.
We collect Employment-Related Information. In conjunction with certain events and promotions, we may collect your company name and job title. If you apply for a job, we collect information you submit as part of your application and resume. This might include your work experience and previous employment, the job(s) you are interested in, and your certifications and licenses. We may also conduct a credit check, background check, and/or employment verification to the extent permitted by applicable law.

We collect Audio/Visual Information. For example, we may record audio during customer services calls.

We collect and develop Inferences. Using the other pieces of personal information collected about you, we may draw inferences about you, reflecting what we believe to be your preferences, characteristics, predispositions, and attitudes.

We collect Information You Submit, Provide, or Post. For example, we collect feedback, messages and any other information you provide when you contact us. We also collect information if you create an account.

SECTION 2: How we use personal information

We use the above-referenced categories of personal information for the following purposes:

We use information to provide you with services and fulfill and process transactions.

We use information for marketing purposes. For example, we might use personal information to provide you with information and updates about our services, promotions, special offers, and new services. These might be our own offers or products, or third-party offers or products we think you might find interesting. We may use information to serve you content and ads that we think you may be interested in. To learn about your choices for these communications, read Section 5 below.

We use information to communicate with you about our relationship. For instance, we will use your information to provide support and to respond to your requests or questions. We may use information to contact you in response to your feedback or to communicate other matters related to our relationship with you (such as about updates to this Privacy Policy or our Terms of Use).

We use information to test, analyze, develop, improve, and provide our Site and services. For example, we may use your information to make improvements to the functionality or operation of our Site. We might use your information to customize your experience with us and to conduct research and analysis. We might use your information and feedback to change or improve the services we offer. We might conduct research with your information to assist with our overall business planning and operations.

We use information to comply with our obligations, administer our websites and services, and for internal operations. For example, we use personal information to administer the Site, such as troubleshooting, data analysis, and testing.

We use information for security, safety, and due diligence purposes. For example, we may use personal information to protect our company, customers, and business partners and their respective personnel. We may also use personal information to protect our Sites, as well as to detect and investigate activities that may be fraudulent, or otherwise illegal or prohibited (such as cyber attacks, spam or phishing attempts, or fraudulent transactions or activities). We may also use information to conduct background, employment, and credit checks.

We use information for hiring purposes. If you submit a job application, we will use any related information to review your job applications and contact you about employment opportunities. If you choose to voluntarily submit your ethnicity, gender, disability status, and/or veteran status in connection with a job application, we will use that information for statistical tracking purposes (not for hiring decisions), in accordance with applicable law.

We use information for verification purposes. For example, we will use certain pieces of personal information to verify your identity if you make requests pursuant to this Privacy Policy. The verification steps and the pieces of personal information that we request may vary depending on the sensitivity and nature of your request. To access areas of the Sites reserved for account holders, we will use your information to authenticate your login attempt.

We use information as otherwise required or permitted by law, or as we may notify you. For instance, we use your information for general compliance purposes and to operate our business on a day-to-day basis.

We may use information to create deidentified and/or aggregated data. We may use and disclose this deidentified or aggregated data as we choose.

SECTION 3: Sources from which we collect personal information

We and our vendors collect personal information about you from various sources, directly and indirectly, including from the following sources:

We collect personal information directly from you. For example, we collect information if you create an account, participate in a promotion or other program, contact us, sign up for our communications, post a comment or send feedback, make a request, or complete a survey. We also collect and receive information if you request an appointment through one of our network providers, fill out patient forms, or pay for services. If you apply for a job, we will collect any information you provide with your application.

We collect personal information from your devices. We use tracking tools like browser cookies and web beacons to passively collect information about you and your devices. We collect information using these tracking tools when you interact with our Site or the emails that we or our vendors send to you. To learn about your choices for these tracking tools, read Section 5 of this Privacy Policy.

We receive personal information from vendors we hire to work on our behalf. For example, vendors that host or maintain our Sites, process payments, or send promotional emails for us may give us information. Our employment and recruiting vendors also give us information. Our marketing agencies, advertising technology vendors, and analytics providers may also provide us with information.

We receive information about you from other sources. Other parties may give us personal information about you. These other parties might also include business and marketing partners, health system partners, network providers, and social media platforms that give us information they have collected either directly or indirectly from you. In the context of job applications, we may also receive personal information from your current or past employers, background check providers, and record verification providers, and if you choose to import your information from a job network or social network, we will get information from those networks.

We combine information. We may combine information that we have collected offline with information we collect online. Or we may combine information we get from another party with information we already have. We may also aggregate your information with other consumers’ information to understand preferences and trends over time.

SECTION 4: We share personal information with other parties

We may share each category of personal information within PRN and the PRN network. This includes our affiliates, network providers, and business units. We share personal information within PRN for all purposes described in this Privacy Policy.

We may share personal information with our network providers. We will share certain information with our network providers so that they can provide the services to you, improve their services, and maintain their relationship with you.

We share your personal information with vendors and service providers who perform services on our behalf. We may share personal information with vendors who assist us with the uses of personal information described in this Privacy Policy. This may include vendors who send emails for us, help us manage and operate our Sites, provide advertising or marketing services, place our advertisements on other platforms, provide analytics and search engine support, track advertising impressions, investigate unlawful activity, inspect and prevent data incidents, provide physical and digital security services, audit our business and financial statements, process payments, process and vet job applicants, and provide legal advice.

We share your personal information with our business partners and for marketing purposes. For example, we might share information with other parties that co-sponsor a promotion or promote our services. Some of these partners may send you information about products or services by mail or email. They may share your information with other third parties. We may also share information with companies that help us with our marketing efforts, including social media platforms, advertising networks, and ad tech companies. For example, we may share email addresses or other contact information with social media platforms so they can serve our advertising to you on their platform. We may share information with other parties so that they can provide you with information and marketing messages about products or services that may interest you. These parties may use the information for their own marketing purposes or the marketing purposes of others. Personal information received by our partners and other parties may also be subject to their privacy policies.

We will share your personal information for safety and security purposes, if we think we have to in order to comply with the law, or to protect ourselves, our customers and others. We may share any or all personal information to respond to a court order or subpoena. We may also share any or all personal information if a government agency or investigatory body requests it. We might share your personal information in order to enforce our agreements and to protect our rights and/or the rights of others. We might share your personal information when we are investigating potential fraud.

We may share your personal information with a successor to all or part of our business. If part of our business (including any of our affiliates, divisions, and business units) is acquired by a third party, we may include personal information as part of that transaction and/or the negotiation and diligence related to that transaction, which may include some or all categories of your personal information. We may also share your personal information if there is a change to our corporate structure. We may also share your information with others as they conduct diligence.

We may share personal information for other reasons we may describe to you from time to time or as permitted or required by law.


SECTION 5: You have choices about how we use your personal information

You can opt out of receiving our marketing emails. To stop receiving our promotional emails, you can follow the instructions in any promotional message you get from us, which may direct you to click an “unsubscribe” link within the email itself. Even if you opt out of getting marketing messages, we will still send you transactional messages. These include responses to your questions.
You can control certain cookies and tracking tools.

  • Your Internet browser may give you the ability to control cookies or other tracking tools. How you do so depends on the type of tool. Certain browsers can be set to reject browser cookies. See the “help” section of your particular web browser for more details on rejecting, blocking, and deleting cookies. Since flash cookies do not reside in your browser, your browser settings will not affect them. To control flash cookies, you thus need to click here.
  • We and third party advertising networks, social media companies, and other services may collect information about your use of the Sites so that they or we may display interest-based advertising using information gathered about you over time across multiple websites or other platforms. To do this, we and our vendors use several tracking tools, such as browser cookies, web beacons, and other technologies. To learn more about the cookies we use and to set your cookie preferences, click on the green Cookie Settings icon link in the lower left side of each Site/Page you visit.   • We use Google Analytics to better understand how our users interact with our websites. You can learn about Google Analytics’ currently available opt-outs at https://tools.google.com/dlpage/gaoptout/.

Please note that options you select and choices you make with regard to cookies and tracking tools are browser, website, and device-specific. This means, for instance, that you need to make your selection on each browser and each device you use to access the Sites. If you clear your cookies or your browser’s cache, you will need to set your preferences again. If you block cookies, certain functionality of the Sites may become impaired or disabled.

Our “Do Not Track” Policy. Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to those signals. If you block cookies, certain features on our site may not work. If you block or reject cookies, not all of the tracking described here will stop.

If you are a Nevada resident, you can request that we not “sell” your “covered information” (as defined in applicable Nevada law). To make a request, email us at compliance@prnpt.com. Please use “Nevada Do Not Sell” in the subject line.

Certain of the Sites may allow you to modify or remove certain personal information that you have provided by following the instructions on the applicable Sites.

SECTION 6: Medical Services, Advice, and Information

Our Site(s) are intended to foster enhanced communications. The Sites do not provide professional medical advice, diagnosis, or treatment.

PRN is not responsible for health-related information provided through the Site(s) that comes from independent providers, such as medical professionals and organizations, including answers to any health-related question you may submit through the Site(s). Any information that PRN itself may provide in connection with the Site(s) is for informational purposes only, and is not intended as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment. Nothing stated or posted on the Site(s) more generally by PRN is intended to be, and must not be taken to be, the practice of medicine, or other professional healthcare advice, or the provision of medical care.

Do not disregard, avoid or delay obtaining medical advice from a qualified healthcare provider. Do not use the Site(s) for medical emergency needs. If you experience a medical emergency, immediately call a health care professional and 911. Your use of information provided through the Site is solely at your own risk.

No licensed medical professional/patient relationship is created by using information provided by, or through the use of, the Site(s).

To the extent required by applicable law, you are responsible for obtaining appropriate authorization or consent to use or disclose the personal information or protected health information of any individual in connection with the Site(s).

Certain information we collect may be “Protected Health Information,” and our use and disclosure of this information may be subject to the requirements of the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations and applicable state law. The term “Protected Health Information” or “PHI” refers to individually identifiable health information about your past, present or future physical or mental health or condition, the provision of health care to you or the past, present or future payment for such care. SECTION 7: Your California Privacy Rights

If you reside in California, you have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes. To make a request, please submit your request in writing by email to compliance@prnpt.com or by mail to PRN, 2035 Corte Del Nogal, Suite 200, Carlsbad, CA 92011. Please include the statement “California Shine the Light” in the subject line of your e-mail or in the header of your mailed letter.

If you reside in California, you can make the following more specific requests with respect to your personal information:

  • Access – You can request that we disclose to you the categories of personal information we collected about you, the categories of sources from which we collected the personal information, the categories of personal information we sold or disclosed, our business or commercial purpose for collecting and selling the personal information, the categories of third parties with whom we shared the personal information, and the specific pieces of personal information we collected about you over the past 12 months.
  • Deletion – You can request that we delete your personal information that we maintain about you, subject to certain exceptions.
  • Do Not Sell My Personal Information – You can request that we not sell your personal information by clicking Do Not Sell My Personal Information. For purposes of this Section, “sell” means the sale of your personal information to an outside party for monetary or other valuable consideration, subject to certain exceptions set forth in applicable California law. Please note that if you would like to opt out of cookie-based tracking for advertising purposes, you may separately set your preferences by clicking the green Cookie Settings icon link in the lower left side of each Site/Page you visit. You can also consult the user instructions for your internet browser relating to the management of cookies and visit www.aboutads.info/choices and https://optout.privacyrights.info to opt out of certain uses of cookies for advertising purposes. Your cookie-related selections are specific to the device, website, and browser you are using. Your selections are deleted whenever you clear your cookies or browser’s cache.

PRN will not discriminate against you because you made any of these requests.

We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests. Except as otherwise provided by applicable California law, note that for purposes of these requests under this Section, “personal information” does not include health information that is protected by HIPAA or the California Confidentiality of Medical Information Act, information about PRN employees, or about employees and other representatives of third-party entities we may interact with in a business capacity. For information about your rights with respect to medical and health information, please review the Notice of Privacy Practices.

We will take reasonable steps to verify your identity prior to responding to your requests. The verification steps may vary depending on the sensitivity of the personal information and whether you have an account with us.

California residents may designate an authorized agent to make a request on their behalf. When submitting the request, please ensure the authorized agent is identified as an authorized agent.

For purposes of California residents making these requests, please also note the following regarding how we collect, use, and share your personal information as described in this Privacy Policy, including in the previous 12 months:

  • We may collect, use, and disclose, for our business and commercial purposes, categories of personal information as set forth in applicable California law, including: Identifiers; payment and customer records information; characteristics of protected classifications under California or federal law (such as demographic information like age); commercial information; professional or employment information; internet or other electronic network activity information; geolocation data; audio, electronic, and visual information; and inferences. See Section 1 above for additional detail.
  • We collect and use these categories of personal information for the business and commercial purposes described in Section 2 of this Privacy Policy.
  • We collect these categories of personal information from the sources described in Section 3 above.
  • We may disclose each of the foregoing categories of personal information for the business and commercial purposes described in this Privacy Policy to the extent permitted by applicable law to the categories of third parties as described in Section 4 of this Privacy Policy.
  • We may “sell” categories of personal information, including: identifiers; payment and customer records information; demographic information; commercial information; Internet or other electronic network activity; geolocation data; and inferences. We may “sell” these categories of Personal Information to the categories of third parties described in Section 4 of this Privacy Policy.

From time to time, we may collect personal information, such as email addresses, in connection with a promotion, offer or discount. Our offers and incentives generally reflect the value of the relationships that we have with the individuals who participate in these programs. Participation in these programs is voluntary and you may withdraw at any time by emailing us at compliance@prnpt.com or by calling us at 800-929-4776 ext 206.

SECTION 8: Our Sites are not intended for children

The Sites are meant for adults. We do not knowingly collect personal information from children under 18. If you are a parent or legal guardian and think your child has given us information, you can contact us at compliance@prnpt.com.

SECTION 9: Security

The Internet is not 100% secure. We cannot promise that your use of our Sites will be completely safe. Any transmission of your data to our Sites is at your own risk. We encourage you to use caution when using the Internet. We keep personal information as long as it is necessary or relevant for the practices described in this Privacy Policy, including, for example, for legal compliance, dispute resolution, contract enforcement, backup, archival, and other internal operations purposes. We also keep information as otherwise required by law. Personal information may be accessed by persons within our organization, or our third party vendors, and those other parties described in this Privacy Policy, including those who require such access to carry out the purposes described in this Privacy Policy, and such other purposes as permitted or required by applicable law.

SECTION 10: We process and store information in the United States

Information we collect may be transferred to, processed in, or stored in the United States. Our Sites are subject to U.S. laws, which may not afford the same level protection as those in your country.

SECTION 11: Links to third-party sites or services

If you click on a link to a third-party website, you will be taken to a website or service we do not control. This Privacy Policy does not apply to the privacy practices of that website or services, which may collect information from you. Read the privacy policy of other websites and services carefully. We are not responsible for these third-party websites or services or their policies.

From time to time we may change this Privacy Policy. We will notify you of any material changes to our Privacy Policy to the extent required by law. We will post an updated copy on our Sites.
